South Carolina?s perennially high ranking in the rate of violence committed by men against women testifies to the difficulty of dealing with this pernicious problem.

South Carolina had the second-worst ranking in the nation for the rate of women killed by men. It was the second year in a row that the state has climbed in the rankings.

The new rating, from 2010, is up from seventh the previous year and ninth the year before that. Several years before that, the state was No. 1 and No. 2.

South Carolina for years has ranked among the 10 worst in the nation when it comes to violence against women. Despite conspicious efforts at many levels to address the problem, it stubbornly persists.

In 2010, 46 women in the state were killed by men, giving South Carolina a rate of 1.94 per 100,000. Nationally, 1,800 women were killed by men, at a rate of 1.22 per 100,000.

Nevada had the highest rate of women being killed by men, but some experts have speculated that legalized prostitution in Nevada might have skewed the results to some degree. Tennessee ranked third in the nation.

In addition to women killed by men, tens of thousands more are victims of domestic violence. This is a crime where women, by and large, are victimized by men they know.

In 2006, state lawmakers stiffened penalties for repeat offenders and required special training for judges who try domestic violence cases. More prosecutors were hired to handle domestic violence cases.

Locally, the 16th Circuit Solicitor?s Office established a special court to review domestic violence cases twice a month. In cases that don?t involve more violent crimes, first-time offenders sometimes are given the option of intervention and treatment instead of jail time.

That is a progressive approach to the problem. The state needs to focus on offenders, some of whom can be successfully rehabilitated, as well as the victims.

We know that children who are raised in homes where domestic violence occurs are more likely to commit domestic violence or be victimized by it themselves. Early intervention might help break the cycle in some families.

We, as a society, need to encourage women in violent relationships to leave and seek help. And we need to establish safe havens, such as Rock Hill?s Safe Passage, which provide a refuge for women who need physical, spiritual and financial support after exiting an abusive relationship.

Relatives and neighbors who witness domestic violence also need to take an active role and report it to the proper authorities. Domestic violence has been a secret crime for too long, and bringing it into the open can save lives.

South Carolina might also benefit from increased efforts by sociologists and other public health experts to pinpoint why the state continually ranks so high in violence against women. What exactly are the factors that make this state more conducive to domestic violence than other states?

By now we should be aware that there are no easy or obvious solutions. If there were, the state would have embraced them.

The state isn?t hampered by a lack of will to address this issue but by a lack of good information about what fuels such a high level of violence and how to prevent it. We need to try harder to find the answers.

Marchionne keeps ACEA presidency after VW spat

PARIS (Reuters) - Sergio Marchionne, president of European carmakers' association ACEA, said he had not resigned that role at a board meeting on Friday after calls by German automaker Volkswagen for him to go.

Marchionne's repeated calls for co-ordinated production capacity cuts to help alleviate Europe's car market crisis have highlighted a division between Europe's money-losing mass market carmakers, including Fiat , of which Marchionne is chief executive, and their better-performing German rivals.

A sparring match between Marchionne and Volkswagen began with remarks Marchionne made in a newspaper interview about the German carmaker.

Marchionne said after the board meeting at the Paris auto show: "We're good friends," referring to Volkswagen Chief Executive Martin Winterkorn, as they embraced for a photo.

Marchionne said on Thursday he would be prepared to resign from ACEA if he lost support of the board. He told Reuters late on Thursday he was not expecting any "fireworks", however.

Marchionne suggested in a New York Times interview in July that Volkswagen was undercutting competitors by engaging in a price war in Europe, where manufacturers are struggling, leading to a call by Volkswagen for Marchionne to resign from his ACEA role.

Town debates future of house of Hitler's birth

BRAUNAU, Austria (AP) ? Living space in Braunau is scarce, but an imposing Renaissance-era building stands empty in this post-card pretty Austrian town because of the sinister shadow cast by a former tenant: Adolf Hitler.

With its thick walls, huge arched doorway and deep-set windows, the 500-year-old house near the town square would normally be prime property. Because Hitler was born here, it has become a huge headache for town fathers forced into deciding what to do with a landmark so intimately linked to evil.

The building was most recently used as a workshop for the mentally handicapped, which some saw as atonement for the murders of tens of thousands of disabled people by the Nazi regime. But that tenant moved out last year for more modern quarters.

The departure reignited debate on what to do with the house that burst from the town hall chamber into the public domain last week after the mayor declared that he preferred creating apartments over turning the building into an anti-Nazi memorial.

"We are already stigmatized," Johannes Waidbacher told the Austrian daily Der Standard. "We, as the town of Braunau, are not ready to assume responsibility for the outbreak of World War II."

That sparked a storm of criticism, with Waidbacher accused of trying to bury memories of the Nazi past.

The comments were particularly ill-received due to the fact that Braunau's town council only withdrew honorary citizenship from Hitler last year, 78 years after the Nazi dictator was given the accolade ? as did nearly a dozen other towns and cities after checking their archives.

Stung by the criticism, Waidbacher has since stepped back, saying he can conceive of "all possible uses" for the building.

On Thursday, Waidbacher expressed surprise at the vehement reaction his comments caused, saying he did not mean to make light of the significance of the house. "Our town has definitely done its homework as far as its past is concerned," he told The Associated Press.

Nonetheless, concerns about the building's fate continue to reverberate on the ancient cobble-stoned streets of this town of 16,600.

One major fear: The house could fill up with Hitler worshippers if converted into living space.

"These are certainly people we don't want here," said town council member Harry Buchmayr, noting that most visitors are not normal tourists but neo-Nazis stopping to pay homage to Hitler, even though he spent only the first few months of his life in the building.

And it's unclear who else might want to take up residence in the house.

"I wouldn't want to live there," said 19-year-old Susanne Duerr, as she paused from pushing her baby carriage to gaze at the yellow stucco building. "I think I would have a bad conscience."

Other townsfolk old enough to remember the Fuehrer echo that sentiment. Georg Hoedl, 88, recalls Hitler as the man who dragged depression-era Austria and Germany out of the kind of abject poverty that forced him to go begging. But he also is aware of the evil Hitler spawned.

"There should be something else inside, something cultural. But apartments ? I'm not for that," he said

Wife Erika, 73, says that bearing the burden of the house's legacy "wouldn't be pleasant for the tenants ? once they moved in they would be asked about this all the time."

Austria's Interior Ministry has rented the house since 1972 from the owner, a woman in her 60s who refuses to be identified publicly. The ministry has been careful to sublet only to tenants with no history of admiring Hitler. Asked about the debate, Interior Ministry spokeswoman Sonja Jell said the ministry remained "particularly sensitive" about the future uses of the building considering its legacy.

The owner refused a request by Braunau officials to let the city mount a sign on the house warning of the evils of the Nazi past. But an inscription on a chunk of granite on public property near the building calls out to passersby: "Never again fascism, never again war."

The building still has the initials MB in the iron grillwork above the massive wooden doorway. It stands for Martin Bormann, Hitler's private secretary, who bought the house shortly before World War II with thoughts of turning it into a shrine to the dictator.

The house is one of the few remaining structures directly linked to Hitler.

A house in nearby Leonding where he spent some teenage years is now used to store coffins for the town cemetery. At that graveyard, the tombstone marking the grave of Adolf Hitler's parents, a place of pilgrimage for neo-Nazis, was removed last year at the request of a descendant. A school Hitler attended in Fischlham, also near Braunau, displays a plaque condemning his crimes against humanity.

The underground bunker in Berlin where Hitler committed suicide on April 30, 1945, was demolished after the war. It was left vacant until the East German government built an apartment complex around the site in the late 1980s. The apartments, which are still occupied, overlook the German capital's monument to victims of the Holocaust.

Ultimately, it's the owner who will decide the Branau building's fate. She's known to be opposed to turning it into a Holocaust memorial, meaning there's still a chance it could be converted into apartments.

That's a nightmare scenario for Buchmayr, a member of Austria's Socialist Party that has done much over the past four decades to sensitize citizens to their country's Nazi past.

"You can't simply wish it away," Buchmayr said of the house. "Unfortunately we have it here.

"Hitler was born here."

(AP) ? Police have located a 1951 theft report from the Baltimore Museum of Art of a Renoir painting matching the description of one that turned up recently at a West Virginia flea market.

The report from Nov. 17, 1951, was uncovered Friday. It says there was no evidence of forced entry at the museum. The painting was valued then at $2,500.

A Virginia woman bought the painting for $7 at the flea market in 2010. It was expected to fetch $75,000 at a now-postponed auction.

Museum officials were combing through paper records to learn more about the theft. So far, they have found a record documenting the painting was on loan from art patron Saidie A. May.

Before the police report, it was the only record of the painting being stolen.

7 Surprising Things Fashion Week Can Teach You About Marketing ...

Two weeks ago, I found myself in New York City attending Rachel Zoe?s private fashion show and wondering how I got there.

Before that night, the only runways I had been on were at the airport.

But don?t worry, it might have been unfamiliar territory, but I didn?t waste the opportunity. I did what any good entrepreneur would do when surrounded by supermodels. I analyzed the marketing strategies.

And I have to say, I learned a few things. In fact, here are 7 insights about Fashion Week that you can use to more successfully market your business and yourself.

1. Rally the people who believe what you believe.

I had never heard of Rachel Zoe until that night, but almost everyone else had. They were part of her fashion community. They watch her TV show. They look at all of her designs.

In short: they believe fashion and design are important.

Most strong communities are built around a common belief system. The strange thing is that most marketers waste their time and money trying to convince people to change their beliefs.

Rachel didn?t waste her time trying to convince people like me to love her work. If you?re leading a business or a movement of any type, the goal isn?t to force people to think like you. The goal is to rally the people who don?t need to be fixed.

2. Dream big, start small.

If you wanted to be a fashion designer it would be easy to look at Rachel Zoe now and think, ?Ugh, it?s so easy for her. I wish I could have that.?

Two things.

First, you can, so don?t cut down your own dreams. Second, the only way to make progress is one step at a time.

Do you know the first person Rachel Zoe did fashion design for? Her next door neighbor. She laid out all of his clothes for the week.

It sounds so simple, but what you have right now is enough to get started on your dream. Start with what you have and start now.

I?m sure Rachel Zoe still has big dreams about where she wants to go with her career, but she will probably start small by designing the next piece of clothing.

3. Launches attract attention.

Fashion Week is a big production. As a result, it gets a lot of attention. Major companies like American Express and Mercedes Benz roll in to sponsor it. Thousands of people pay to attend. Major celebrities show up.

Do you know the only reason all of this happens? It?s because the people who run Fashion Week decided to make it one big product launch. It only happens once each year. Tons of blockbuster designers show up. People plan their schedules around it.

If you?re launching a business or a product of some type, then consider how you can make it something for people to look forward to. It doesn?t have to be an event in the physical world (although that would be great). Just give people something to point to and say, ?I want to be there for that.?

4. Market around events to drive yourself forward.

Having trouble getting things done? Feel like your business is languishing and you?re not sure what to work on next? Have five or six open projects instead of one or two completed ones?

Use events to push your business forward and get things done.

Every designer who has a show going on the runway knows that they need to be finished by the time the first model walks out onto the stage. There is a deadline for completion that can?t be adjusted.

Having deadlines that can?t be adjusted is an excellent way to improve your productivity because it forces you to get something out to the world ? even if it?s smaller than you imagined.

Use events ? speeches, meetings, webinars, conferences ? to force yourself to complete tasks and market your product publicly.

5. Rigid thinking benefits no one.

Sure, some of the designs at Fashion Week are off?the?wall and over?the?top, but so what? If everyone stuck with what we already do, then we would all end up stuck.

Whenever you try something new there will be a lot of mistakes made. (And let?s be real: when I see someone coming down the runway dressed like Big Bird, I?d call that mistake.)

But in the end, making mistakes is the only way forward. You can either play it safe in the world someone else created, or you can push the envelope and (possibly) create a new world for everyone to enjoy.

6. Success unshared is failure.

Take a moment to imagine the thousands of people wearing Rachel Zoe designs. Now imagine if she had kept those designs to herself. Imagine if she simply drew them up in her free time and filed them away in a drawer.

That?s exactly what many would-be business owners do! They think up great ideas, but then talk themselves out of sharing them with the world.

It doesn?t matter how great your ideas are or how brilliant your plan is, it only becomes meaningful once you allow other people to take part in it. Your value doesn?t come from the achievements you enjoy, but the people you share them with.

Sidenote: The people you share your ideas with are the only ones who can make it a success. Every person at that fashion show can now be an advocate for Rachel Zoe and her work because she shared it with us.

And yet, what do new entrepreneurs do? They ask advisors to sign an NDA before they reveal the million dollar idea. They hoard their thoughts in private spreadsheets and documents for fear of getting them stolen. Stop overestimating the risk of letting other people in on your idea and start realizing that sharing your work is the only way for it to become successful.

7. Give away something nice.

Apparently, the gifts at Fashion Week weren?t very good. I didn?t even notice until the third person came up to me complaining about the ?lame? gift bags.

At first, my response was, ?It?s free, people. Let?s get serious here. How do you complain about something you don?t have to pay for? If you don?t like it, don?t take it.?

DNP Cisco acquires WiFi data analyst firm ThinkSmart Technologies

Networking kingpin Cisco announced on Wednesday that it had acquired ThinkSmart Technologies, a company that analyzes location data by using WiFi technology. ThinkSmart's tech reviews a network's infrastructure by evaluating the movement of its users, traffic patterns and hours of operation. The firm then uses these analytics to help companies optimize network and staffing configurations for business operations -- a long way of saying that it's smart enough to tell a company how to better manage information flows through a network. The terms of this deal have yet to be released, but Cisco seems to think this was a smart pick up.

PFT: Ray Lewis rips refs, but he's wrong this time

Well, at least he?s consistent.

Last week, after a one-point loss to the Eagles, Ravens linebacker Ray Lewis railed on the replacement referees.

This week, after a one-point win over the Patriots, Lewis was at it again.

Via 105.7 The Fan in Baltimore, Lewis complained about a penalty called on safety Ed Reed for hitting New England receiver Deion Branch in the head while defenseless.? The penalty fueled a drive that resulted in a field goal that extended the Patriots? fourth-quarter lead to nine.

?He turned his head to the side and clearly hit him with his shoulder pad,? Lewis said.? ?Those things cannot affect the way this game is played.? And then the saddest part about it is when you hear other people say, ?Oh, those are the rules.?? For real?? That?s not the rules.? The rules of this game is, ?Do whatever you gotta do, by any means necessary.??

It would be easy to crack a joke right here, but Ray?s ignorance of the rules is alarming.? Does no one in the Ravens organization explain these rules to the players?? Or does coach John Harbaugh show them a Saturday night Power Point presentation that says, ?The rules are there ain?t no rules??? Or has Ray simply delivered and/or received too many helmet-to-helmet hits of his own?

Lewis has been playing the game long enough to know better.? And when it comes to the hit applied by Reed to Branch, Lewis ignores the fact that Reed hit Branch in the helmet.? Defenseless players can?t be hit with a helmet or in the head/neck area.? While helmet-to-helmet hits are a subset of the forbidden types of contact against defenseless players, a forearm, elbow, shoulder, midsection, etc. to the head of a defenseless player should always trigger a flag.

Making Ray?s rant even less persuasive is the fact that folks are now pointing (incorrectly, we believe) to the absence of flags on key helmet-to-helmet hits like the one against Raiders receiver Darrius Heyward-Bay as evidence that the replacements are jeopardizing the safety of players.? First, the regular officials often misses calls like that.? Second, the league office doesn?t miss them, dishing out five-figure fines on the following Friday.

But reason and logic and common sense don?t matter.? As explained earlier this morning, the tipping point has been reached regarding the officiating lockout.? Ray?s remarks ? nonsensical as they may be ? capture the mood of the fans, from hardcore to casual.? The NFL needs to get this worked out, or the fans will soon be voting with their wallets and their eyeballs.

?So You Think You Can Fool Potential Customers By ... - Sajen Legal

In a recent decision, the Federal Court of Australia shed light on the subsequent liability arising from using a competitor?s registered trademark in domain names and websites.?

In Edgetec International Pty Ltd v Zippykerb (NSW) Pty Ltd, Justice Reeves explored the provisions of the TRADE MARKS ACT 1995 while explaining when a registered trademark will be considered infringed.

Facts:?

Edgetec (Applicant) sold franchises for concrete edging businesses and trades under the name Kwik Kerb.??

Zippykerb (Respondent) sold equipment, training and marketing materials to concrete edging businesses and trades under the name Zippykerb. Mr George May, the second respondent, was the main individual behind Zippykerb.?

Edgetec was the registered owner of five trademarks, which it used in connection with its concrete edging business. Two of those trademarks were word marks and the other three were stylized marks.??

In the present application, Edgetec claimed that Zippykerb and Mr May have used two of their registered trademarks, as trademarks, in two ways.

First, out of the internet domain names registered by Mr May, the first three domain names used the words ?Kwik Kerb? .?

Secondly, Edgetec complained that all of the domain names were linked to a single website, www.zippykerb.com. When one opened that website, the words ?Kwik Kerb? appear numerous times in different contexts on the web pages located on that site.??

Edgetec claimed that the majority of these uses of its registered trade marks ?Kwik Kerb? were in breach of the provisions of the Act. Edgetec sought a permanent injunction against Zippykerb.?

Key point:?

Whether, use of words similar to a registered trademark in domain names and on websites can be considered as infringement.??

Decision:

JusticeReeves found the following:

  1. ?While the vocabulary of the English language is common property available for use by all traders to describe their goods and services, words or expressions that have been coined or invented and used as such to signify a particular trader?s goods and services are generally not. On a side-by-side comparison, the signs or words ?Kwik Kerber?, ?Kwik Kerb er? and ?Kwik Kerbing? are all substantially identical to Edgetec?s registered trade marks ?Kwik Kerb?. Dealing first with the essential features of the registered trademarks, they both begin with the coined word ?Kwik? and that word is then immediately followed by (but separately from) the English word ?Kerb?.

  2. The appearance and separation of the first two words in both, including the capitalisation of the letters ?k?, is identical. The only differences are that Zippykerb has added the letters ?er? (sometimes with a space) or ?ing? after the word ?Kerb?. However, taking into account that the first eight letters are identical in all respects. The addition of the two letters ?er?, nor the three letters ?ing?, at the end, significantly affects the total impression of resemblance between the two. Thus, the signs or words used by Zippykerb on its website are substantially identical to Edgetec?s registered trade marks.

  3. Zippykerb used the substantially identical signs or words in a domain name to redirect internet users to its website and that website displays, as it plainly does the goods and service being offered by Zippykerb, this is trade mark use of those signs or words. That is so because this use of a domain name to redirect potential customers to a website displaying one?s goods and services is analogous to using those words as a sign on the front of a shop to indicate the goods or services that are sold within.

  4. In each of the eight uses, the ?Kwik Kerb? mark has been used to attempt to distinguish Zippykerb from Kwik Kerb, or to compare the price of Zippykerb?s product with the product associated with the ?Kwik Kerb? mark. It may be accepted that none of these particular uses is a trade mark use. Nonetheless, they do not, in my view, act to reverse or ameliorate the trade mark usage of the ?Kwik Kerb? mark that has occurred elsewhere on Zippykerb?s website.

Thus, Justice Reeves?granted the permanent injunction sought by Edgetec

Lesson:

The case highlighted that displaying statements stating that the goods and services offered in a website are not those of the holder of the registered trademark in a website will not clear you off the subsequent trademark infringement liability for using the registered trademarks in the websites and domain names.

Many of our sheep develop abscesses after shearing. What's the cause of this and how do we deal with the abscesses?

Dear Lisa:
Virtually every sheep and goat producer faces the age-old problem of recurring abscesses in the flock. Most of these abscesses can be attributed to the bacteria Corynebacterium ovis and the disease called caseous lymphadenitis, or CLA. While many shepherds view the disease as a harmless problem, CLA can cost sheep and goat producers a lot of money in terms of decreased reproduction and production efficiency, as well as the cost of labor and drugs to treat affected animals.

The disease seems to be more common in western and south-central United States, where sheep are more likely to graze year-round in an environment conducive to skin abrasions. Sheep can actually contract the bacteria through ingestion, inhalation, or penetration through intact skin. However, most do become infected via contact between infectious exudate and skin wounds. Contact with infected feeders, bedding, or equipment can spread the disease. Your sheep probably become infected at shearing time, when minor skin nicks and abrasions routinely occur. Once the clippers become infected, disinfection is difficult, and since the abscesses are not always so visible, spread from one clipped ewe to the next unclipped one is very likely.

So how do we treat these abscesses? For the simple once-a-year abscess, the treatment is easy. Isolate the animal first, as an abscess that is broken contaminates the environment with thousands of potential abscess-forming organisms. Trim the hair around the abscess and hot pack for three to four days. If the lump fails to come to a head and break, lance it (make an incision at the bottom) with a clean blade and continue to hot pack. Consult your veterinarian for appropriate antibiotics.

If the abscesses are a herd problem, draining many abscesses and administering systemic antibiotics may simply result in temporary improvement. The bacteria produces thick-walled abscesses and the capsule serves to keep the bacteria in and the antibiotics out, even if the abscesses are drained and flushed. Infections are likely to recur once treatment is discontinued. Long-term antibiotics may be economically impractical. Segregation of ewes with abscesses is of paramount importance until the abscess is opened and no longer draining.

In herd problems, it is extremely important to sanitize shears, combs, cards, and dipping vats, along with knives and emasculators. You can use quaternary ammonium compounds, chlorhexidine, hypochlorite solutions, iodines, and phenolic solutions on equipment once you remove organic material with hot water and a detergent. You should remove dirt from floors, walls, and walkways, and clean them with steam and detergent as well.

HBT: Dodgers' Kershaw cleared for Sunday start

Dodgers left-hander Clayton Kershaw made it through an easy 20-pitch bullpen session on Friday afternoon without experiencing any lingering pain or discomfort in his troublesome right hip. He was not sore when he woke up Saturday morning and felt strong Sunday when he met with team doctors.

NASA to broadcast Neil Armstrong memorial service Thursday

If you're not among the lucky few people who will get to bid farewell to late astronaut Neil Armstrong in person Thursday (Sept. 13), you can still watch the proceedings live online.

Armstrong, the first person ever to set foot on the moon, will be memorialized Thursday at Washington National Cathedral in Washington, D.C., in a ceremony that starts at 10 a.m. EDT (1400 GMT). The few public passes to the event have been snapped up, but it will be broadcast live on NASA TV and the Washington National Cathedral's website, space agency officials said.

"Tomorrow morning at the National Cathedral, the country will bid farewell to one of our most cherished heroes," Senator Bill Nelson (D-FL) said during a Senate subcommittee hearing Wednesday discussing NASA's plans to explore space beyond low-Earth orbit. [Photos: Neil Armstrong Remembered]

When Armstrong's boot crunched into the gray lunar dirt, "it was one of the country's proudest and most riveting moments," Nelson added.

Many dignitaries are slated to attend Thursday's ceremony and pay their respects to Armstrong, who died Aug. 25 following complications from a recent heart surgery. The VIP list includes NASA chief Charlie Bolden and deputy administrator Lori Garver, along with a number of current and former astronauts, NASA officials said.

Bolden and former Secretary of the Treasury John Snow will offer tributes, as will Apollo 17 commander Gene Cernan, the last person to walk on the moon.?Armstrong's Apollo 11 crewmate Michael Collins will lead prayers, and the Right Rev. Mariann Edgar Budde, bishop of Washington, will give a homily. Singer-songwriter Diana Krall will perform "Fly Me to the Moon" at the service, according to Washington National Cathedral officials.

During the ceremony, NASA chief historian Bill Barry will participate in an online chat, giving readers more information about the speakers and outlining their relationship to Armstrong and the space agency, officials said.

Armstrong became an American icon when he stepped onto the lunar surface on July 20, 1969. The words he said upon doing so are among the most famous ever uttered: "That's one small step for [a] man, one giant leap for mankind."

Neil Armstrong and fellow Apollo 11 astronaut Buzz Aldrin spent more than 21 hours on the lunar surface, while Collins orbited above them in the mission's command module Columbia. The three men returned safely to Earth on July 24, 1969, fulfilling a pledge made by President John F. Kennedy eight years earlier and notching a huge victory for the United States in the Cold War space race against the Soviet Union.

Armstrong was memorialized Aug. 31 in Cincinnati, but that was a private ceremony limited to friends and family. Thursday's service serves as the nation's send-off to one of its most famous citizens.
